These Terms and Conditions ("Terms") govern your access to and use of the Interoperability Platform ("D2.2D" or "the Platform"), operated by the Government of Sint Maarten.

By creating a session on D2.2D, submitting a service request or making a payment through the Platform, you agree to be bound by these Terms.

1. Definitions

"Platform" means the D2.2D interoperability service, including its website, APIs, connected registries and service workflows.

"User" means any individual or authorized representative of a business who accesses the Platform.

"eID" means the digital identity credential issued under the Government of Sint Maarten's Digital Identity Programme and used to authenticate Users through Single Sign-On (SSO).

"Registry" means an authoritative government record-keeping system — including the Civil Registry, Tax Registry, Land Registry and Address Registry — that D2.2D connects to in order to verify or exchange data for a particular Service.

"Service" means any transaction offered through D2.2D, currently comprising National ID, Issuance of Certificates, Sole Proprietorship, Driver's License, Life Events Services and Address Change.

"CxPay" means the third-party payment gateway connected to D2.2D for processing applicable Service fees.

2. Eligibility and Access

You must hold a valid and active eID and authenticate through Single Sign-On to access Services on D2.2D.

Access to specific Services may be subject to additional eligibility requirements, including age, residency, business ownership or other requirements established by the responsible government agency or Registry.

You are responsible for keeping your eID credentials confidential and for all activity that occurs on the Platform through your authenticated session.

3. Description of Services

D2.2D provides an interoperable gateway to the Services offered through the Platform. Each Service may be verified in real time against its responsible government Registry.

D2.2D is not itself the authoritative source of any government record. It retrieves, displays and, where authorized, updates information held by the relevant Registry.

The availability, eligibility requirements, required documents and processing times for each Service are determined by the responsible government agency and may change independently of these Terms.

4. Accuracy of Information

You agree to provide true, current and complete information when using any Service.

Providing false or misleading information may result in the rejection, delay, reversal or referral of your request to the relevant authority, and may have legal consequences under applicable Sint Maarten law.

5. Fees and Payments

Applicable government service fees will be displayed before you confirm your request.

Payments are processed through the connected payment gateway. D2.2D does not store your full card or payment credentials.

Fees are generally non-refundable once a Service request has been successfully submitted to the responsible Registry, except where required by law or where a technical failure results in a duplicate or failed transaction.

Refund requests should be submitted through the applicable support channels.

You are responsible for any charges imposed by your bank or card issuer that are outside the control of D2.2D or the payment provider.

6. Service Availability and Modifications

D2.2D is provided on an "as available" basis.

Scheduled maintenance, Registry downtime or circumstances beyond reasonable control may temporarily affect the availability of one or more Services.

The Government of Sint Maarten reserves the right to add, remove, suspend or modify Services, features or fees, with reasonable notice where practicable.

7. Data Verification and Registry Exchange

By using a Service, you consent to D2.2D querying and — where required for the Service — updating the relevant Registry on your behalf for the purpose of completing your request.

8. Prohibited Uses

You must not use D2.2D to:

• submit fraudulent, false or impersonated information;
• attempt to access another person's or business's records without authorization;
• interfere with or disrupt the Platform's security, integrity or availability; or
• use the Platform for any purpose that violates applicable Sint Maarten law.

9. Intellectual Property

All content, branding and software associated with D2.2D — excluding User data and data held by government Registries — remains the property of the Government of Sint Maarten or its licensors and may not be reproduced without permission.

10. Limitation of Liability

To the fullest extent permitted by law, the Government of Sint Maarten is not liable for indirect, incidental or consequential loss arising from your use of D2.2D, including loss resulting from Registry downtime, third-party payment processing issues, or reliance on information subsequently corrected by the responsible Registry.

11. Suspension and Termination of Access

Access to D2.2D may be suspended or terminated, in whole or in part, where there is reasonable belief that these Terms have been violated, where required by law, or where necessary to protect the security or integrity of the Platform or connected Registries.

12. Third-Party Services

D2.2D relies on third-party and government services, including payment processing and the Government of Sint Maarten's Digital Identity Programme for authentication.

Use of those services may also be subject to their respective applicable terms and conditions.

13. Changes to These Terms

These Terms may be updated from time to time to reflect changes to the Platform, applicable requirements or government services.

Material changes will be notified on this page together with an updated effective date.

Continued use of D2.2D after changes take effect constitutes acceptance of the revised Terms, subject to applicable law.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Sint Maarten.

Any dispute arising from your use of D2.2D shall be subject to the jurisdiction of the competent courts of Sint Maarten, without prejudice to any mandatory consumer-protection rights.
